  1. General provisions

 

1.1. These Rules of Purchase and Sale of Goods (hereinafter referred to as the “Rules”), if the Buyer agrees with them (after reading the Rules and ticking the box “I have read and agree with the rules of“ jokado.lt ””), are a legal document binding on the parties. The rights and obligations of the Buyer and the Seller, the conditions of purchase and payment for the goods, the procedure of delivery and return of the goods, the liability of the parties and other provisions related to the purchase and sale of goods in the jokado.lt online store.

 

1.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by law. The Buyer who has registered will be notified of any changes, corrections or additions by the e-mail specified in the login and will have to re-accept the changed Rules in order to purchase goods in this online store.

 

1.3. You have the right to buy in our e-shop:

 

1.3.1. able-bodied natural persons, i. persons who have reached the age of majority and whose capacity is not restricted by court order;

 

1.3.2. minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, unless they are self-employed;

 

1.3.3. legal entities;

 

1.3.4. authorized representatives of all the above persons.

 

  1. Protection of personal data

 

2.1. Any information related to personal data and registered in the online store "jokado.lt" is subject to the Seller's personal data protection policy, the conditions of which are detailed in the "Rules on personal data protection" on the website. In order to register in the "jokado.lt" online store, the buyer must confirm that he agrees with the "Rules on personal data protection".

 

  1. The moment of concluding the purchase and sale agreement

 

3.1. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having selected the purchased item (s) and formed a shopping cart, clicks on the link "Pay".

 

3.2. Each purchase and sale agreement concluded between the Buyer and the Seller is registered and stored in the database of the jokado.lt online store.

 

  1. Buyer's rights

 

4.1. The Buyer has the right to purchase goods in the "jokado.lt" online store in accordance with these Rules and the online store.

 

4.2. The Buyer has the right to withdraw from the contract of purchase and sale of goods concluded with the "jokado.lt" online store by notifying the Seller in writing (by e-mail, indicating the product to be returned and its order number) no later than within 7 (seven) working days from the item delivery dates.

 

4.3. Rules 4.2. The right of the Buyer provided for in paragraph 1 shall be exercised in accordance with the August 17 by order no. 258 approved "Rules for the sale of goods and provision of services when contracts are concluded by means of communication".

 

4.4. Rules 4.2. The Buyer may exercise the right provided for in paragraph 1 only if the goods have not been damaged or their appearance has not substantially changed, nor has it been used.

 

  1. Obligations of the Buyer

 

5.1. The Buyer must pay for the goods and accept them in accordance with these Rules.

 

5.2. The buyer undertakes not to pass on his login details to third parties. If the Buyer loses the login data, he must immediately inform the Seller by the means of communication specified in the "Contacts" section.

 

5.3. By using the jokado.lt online store, the Buyer undertakes to comply with these Rules and other conditions clearly indicated in the online store and not to violate the legal acts of the Republic of Lithuania.

 

  1. Seller's Rights

 

6.1. The seller has the right to set the minimum size of the shopping cart at its own discretion, i. the minimum amount at which the Buyer's order will be processed. The amount of this amount is visible when viewing the shopping cart.

 

6.2. If the Buyer tries to damage the stability and security of the online store or violates its obligations, the Seller has the right to immediately and without notice restrict or suspend his access to the online store or, in exceptional cases, cancel the Buyer's registration.

 

6.3. In the event of significant circumstances, the Seller may temporarily or permanently terminate the operation of the online store without notifying the Buyer in advance.

 

6.4. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Buyer, having chosen 8.2.1. or 8.2.2. do not pay for the goods within 2 (two) working days.

 

  1. Obligations of the Seller

 

7.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the jokado.lt online store in accordance with the conditions set forth in these Rules and the online shopping center.

 

7.2. The Seller undertakes to respect the Buyer's right to privacy of the personal information belonging to him specified in the registration form of the online shopping center, except for the cases specified in the laws of the Republic of Lithuania and the “Rules on Personal Data Protection”.

 

7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in Clause 9 of the Rules.

 

7.4. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer a similar or as similar a product as possible. If the Buyer refuses to accept an analogous or similar product, the Seller undertakes to return the money paid to the Buyer within 3 (three) business days, if the advance payment has been made.

 

  1. Prices of goods, payment procedure and terms

 

8.1. The prices of the goods in the online store and in the formed order are indicated in euros with VAT.

 

8.2. The buyer pays for the goods in one of the following ways:

 

8.2.1. Payment using electronic banking is a prepayment using the electronic banking system used by the Buyer. In order to use this form of payment, the buyer must have signed an electronic banking agreement with one of the following banks: AB bankas Swedbank; AB DNB Nord Bank; AB SEB Vilniaus bankas; AB Citadele bankas; AB Šiaulių bankas; AB Danske Bankas; AB Nordea bankas. When paying for the goods in this way, the Buyer generates a payment in the electronic banking system according to his paid order. The Buyer transfers the money to the account of the "jokado.lt" online store in the respective bank of his choice. The responsibility for data security in this case lies with the respective bank, as all monetary transactions take place in the bank's electronic banking system.

 

8.2.2. Payment by bank transfer is an advance payment when the Buyer, after printing the order and going to the nearest bank branch, transfers the money to the bank account of "jokado.lt".

 

8.2.3. Payment in cash upon delivery of the goods - The Buyer pays for the goods during their delivery (transfer - acceptance). The seller reserves the right to request partial payment for the goods under the advance invoice

 

8.3. When paying 8.2.1. and 8.2.2. the Buyer undertakes to pay immediately. In the above cases, in accordance with Rule 6.4. of the Seller's right provided for in paragraph 1, only after receipt of payment for the goods, the formation of the consignment of goods shall begin and the term of delivery of the goods shall begin to run.

 

  1. Delivery of goods

 

9.1. When ordering the goods, the buyer undertakes to indicate the place of delivery of the goods.

 

9.2. The buyer undertakes to accept the goods himself. In the event that he is unable to accept the goods himself and the goods are delivered to the specified address and on the basis of other data provided by the Buyer, the Buyer shall not be entitled to make claims to the Seller regarding delivery of the goods to the wrong entity.

 

9.3. The goods are delivered by the Seller or his authorized representative.

 

9.4. The Seller undertakes to deliver the goods to the Buyer in accordance with the terms specified in the descriptions of the goods. These terms do not apply in cases when the required goods are not in the Seller's warehouse and the Buyer is informed about the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery of goods.

 

9.5. In all cases, the Seller shall be released from liability for violation of the terms of delivery of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Buyer's control.

 

9.6. During the delivery of the goods, the Buyer must check the condition of the consignment together with the Seller or his authorized representative. If the Buyer signs the invoice (bill of lading) or other document of delivery-acceptance of the consignment, it is considered that the consignment has been delivered in a proper condition. If the Buyer notices that the packaging of the delivered consignment is damaged (wrinkled, wet or otherwise externally damaged), the Buyer must mark it on the invoice (bill of lading) or other document of delivery and acceptance of the consignment and, in the presence of the Seller or his representative, draw up a free-form consignment violation report. If the Buyer fails to do so, the Seller shall be released from liability against the Buyer for damage to the goods, if such damage was caused by damage to the packaging, which the Buyer did not mark in accordance with the above procedure.

  1. Product quality guarantee and expiration date

 

10.1. The characteristics of each product sold by jokado.lt are generally indicated in the product description attached to each product.

 

10.2. The Seller is not responsible for the fact that the goods in the online store may not correspond in their color, shape or other parameters to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.

 

  1. Return and exchange of goods

 

11.1. The sold goods are exchanged and returned in accordance with the 2001 June 29 by order no. 217 “On Approval of the Rules for Return and Exchange of Items” approved by the Rules for Return and Exchange of Items.

 

11.2. To return the item (s) 11.1. In the cases specified in the clause, the Buyer must fill in the return document in a free form and submit it together with the returned product (s).

 

11.3. 11.1. The Buyer may exercise the right provided for in the Clause of the Rules within 7 (seven) working days from the day of delivery of the goods to him, informing the Seller thereof 4.2. The procedure provided for in the paragraph of the Rules.

 

11.4. When returning the goods to the buyer, the following conditions must be met:

 

11.4.1. the returned goods must be in the original neat packaging;

 

11.4.2. the goods must be undamaged by the Buyer;

 

11.4.3. the product must not have lost its commercial appearance (undamaged label, peel-off protective film, etc.) (this item does not apply in the event of the return of a defective product);

 

11.4.4. the returned goods must be in the same configuration as received by the Buyer;

 

11.4.5. when returning the goods, it is necessary to present the document of its purchase, the warranty card (if it was issued) and the completed 11.2. The return document specified in the paragraph of the Rules.

 

11.5. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not follow the procedure for returning the goods set out in this Article.

 

11.6. In the event that the goods are returned in accordance with 4.2. the right provided for in paragraph, the Buyer shall bear the cost of returning the goods. Return rates applied by the seller are given in 9.7. In the point of the rules. When the received wrong product and / or defective product is returned, the Seller undertakes to pick up such goods and replace them with similar suitable goods. In case the Seller does not have similar goods, he returns the money paid for the goods (es) to the Buyer.

 

11.7. Return and exchange of goods shall be carried out in accordance with the 2001 Order of the Minister of Economy. June 29 by order no. 217 “Return and Exchange Rules” approved by the Minister of Economy. August 17 by order no. 258 approved "Rules for the sale of goods and provision of services when contracts are concluded by means of communication".

 

  1. Liability

 

12.1. The buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences.

 

12.2. The buyer is responsible for the actions taken using this online store.

 

12.3. The buyer is responsible for transferring his login details to third parties. If the services provided by jokado.lt are used by a third party who has logged in to the online store using the login details of the Buyer, the Seller shall consider this person to be the Buyer.

 

12.4. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, despite the recommendations of the Seller and its obligations, did not read these Rules, even though he was given such an opportunity.

 

12.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations or persons, the Seller is not responsible for the information or activities performed there, does not maintain, control and does not represent those companies and persons.

 

12.6. In the event of damage, the guilty party compensates the other party for the direct damage.

 

  1. Marketing Measures Applied by the Seller

 

13.1. The seller may initiate various promotions in the jokado.lt online store at its own discretion.

 

13.2. The seller has the right to unilaterally, without separate notice, change the terms of the shares, as well as cancel them.

 

  1. Exchange of information

 

14.1. The Seller shall send all notices to the e-mail address provided in the Buyer's registration form.

 

14.2. The Buyer shall send all notices and questions by the means of communication specified in the "Contacts" section of the Seller's online store.

 

  1. Final provisions

 

15.1. These rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.

 

15.2. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these rules.

 

15.3. All disputes arising out of the application of these rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
